This was an un-official line of enquiry as he did not know how the captain would have responded to his presumption. Peter then decided to include this line into his report and hopefully it will all work out, with some valuble information being found.   Peter was quite tired but had determined to make his colleagues' job a little bit easier. Report and conclusions concerning the attack on the USS Venture on Stardate 72558.9   _____   Cobra Fleet As you are all well aware the activities of Cobra Fleet have only recently come to light. The events preceeding the armed conflict between 'official' and 'un-official' Starfleet personelle were quite a stumbling block. Members of the crew of the USS Geneva embarked upon a secret mission to retrieve a Romulan Commander and a Klingon Captain to engage in talks with the Federation and Satrfleet to determine the reasons for the loss of the two vessels which had dissapeared under suspicious circumstances. The truth about the dissapearences only came out after the two, rather too cautious, Klingon and Romulan officers agreed to divulge the information regarding the 'cargo' of the two vessels. It is now known that the vessels contained a 'Cobra Fleet' defector and co-ordinates for the home system of the renegade fleet. Data regarding the dissapearences of the vessels was hard to find, however, the sub-space relay station Alpha-099 did record the destruction of the USS Gideon and provided valuble information regarding the tactics of the then unknown alien vessels. Lieutennant Ryan, myself and a small team of crewmen and Ensigns from the Ops. department started an investigation into the alien ships. During the rendezvous with the Klingon cruiser the Cobra Fleet reapeared and attacked with force, after the Klingon Captain had been rescued and was safely aboard the USS Mithrandir the crew was able to procure some of Cobra Fleet's technology from a recently destroyed ship. The cargo was brought to the USS Geneva and is still the subject of research and debate. The final conclusions will be submitted after all the departments have submitted their analysis and conclusions for consideration Atack on USS Venture The attack on the USS Venture occured around a clustered nebula on Stardate 72558.9. The incident was subject to an investigation by the Admiralty, which suggests that this was indeed an incident of some importance, however the reports into this investigation remain classified and the only information that we have to draw upon are the statements of Cammander Belinia of the USS Endeavour, and Lieutennant Comander David Sachi of the USS Vengence. Both of the mentioned officers were serving officers aboard the USS Venture during the incident. These statements are availible for you all to read upon request. The evidence that we are able to gather suggests that the attacks were indeed of an alien origin as the boarding party from the attacking vessel were not humanly proportioned. However the alien aggressors did have a substantial amount of technology which, as described by both Commander Belinia and Lieutennant Commander Sachi, bear a remarkable simmilarity to the technology of Cobra Fleet. I request that the Captains ask that these two officers attend a small unofficial hearing to determine their knowledge of the technology. This would greatly enhanse our ability to determine whether the Cobra Fleet has alien technology. It must be stated that the two officers have no assumed knowledge of the existence of Cobra Fleet. END REPORT   _____   Peter had spent most of the night working on the computer terminal, trying to get access to the alien data stored within. He now had a workable hypothesis as to how Cobra Fleet had come to have access to such advanced materials. ~But it would be great if the computer terminal being held in the cargo bay would tell us all we need to know.~ He thought. During the night he had worked to construct an interface that would enable the team to access the data within, Peter thought that it would be an easy job considering that the design was, in essence, starfleet. This was not as simple though, the technology and software in the terminal were so advanced that the standard interface would not work. It had taken him several hours and more than one trip to engineering to get the design right. He was now waiting for the diagnostic to be completed, then he would be able to get more answers. He sent the report by secure channel to the senior staff and awaited their replies. John read over the report one more time. So far limited number of people had voiced their decision to leave, however John was still concerned that these numbers could rise. If the rogue elements in Starfleet began to use propaganda it would no doubt adversely effect the station. It had become a realisation that it had become time to leave. It had been a hard choice to come to however he had been in Starfleet for a long time now first as a crewman and then an officer. However now it was time to move on. He had served in the operations department since the leaving of the first Chief of Operations before Wilson. Robert finished packing his bag and then threw the bag over his shoulder and turned his back on his quarters. Robert then moved slowly to the turbo lift he needed to inform the Chief Of Operations of his decision to leave. (Starbase Geneva – Main Operations – Transporter Chief – Ensign O’Neil – 12:55) Robert saw the chief of operations and moved over to him. Pulling a padd from inside his bag and passed it over to the chief. “Ensign Belinia, sir I must inform you of my decision to leave Geneva with immediate effect,” Robert then awaited the Ensign’s reply. With in a few seconds the glory of Geneva began to come into view. Robert sat down by the porthole not moving barely breathing watching Geneva fill the port hole and then disappear as the shuttle jumped to warp. Robert knew he was leaving for a position as Operations aboard a new vessel somewhere but where he did not know. He knew the moment he returned to Earth Starfleet was going to ask some difficult questions of him. However he also knew in his heart he would tell them nothing he would not betray any persons he had served with for so long. Glaring Joseph walked up to him. "Im here to see the admiral, please inform him Commodore Blackford is here to meet with him," The Ensign looked at him and nodded turning back towards the door the Ensign confirmed Joseph's appointment and then nodded for him to enter. As Joseph walked into the admiral's office he stood to attention. "Admiral LoDona sir. Thank you for seeing me on such short notice," Robert nodded, and gestured to a seat. "Have a seat, Commodore." He folded his hands together, "What brings you on such short notice?" He eyed the Commodore, he didn't know the man, and they were in the middle of a civil war, of sorts. His loyalties could become very important in short order. Taking a seat Joseph looked at the admiral. "Admiral, I would like to request your permission to place Ensign Dru Tagon on trial. The Ensign was arrested by my JAG officer on Geneva however he was released to not be allowed of the station. The Ensign committed murder Admiral; I want to put him on trial. With our current situation sir we need to show that even though we have broke away we still enforce the law and will not stand for people taking the law into their own hands," The Admiral folded his hands together, "I trust he is ready to stand trial, how do you plan on trying him?" "My Original idea was to have you at the head of the trial sir, however in recollection I think it would be best if we have a council of Captains to try him. At the end of the day sir with a council of Captains it will carry a lot more weight. If you were to judge alone it may lack legitimacy in the future sir and may send the wrong message," Joseph stated. Robert considered that for a few moments, and then nodded his head. "Very well, it is advantageous then that we have three ships in the immediate area. Find and order Rofellian and Lowell to join the council, if you haven't done so already." "No objections offhand, Sir." she looked at the Commodore, "But I would want to know the charges." "The Charges Captain are Murder and Conduct unbecoming a officer," "Serious charges, especially considering our current political status." she bunched her lip for a moment in thought, as Robert looked on silent, then nodded her head once, sharply. Kara had ordered them about one hour ago to shut down the plasma flow down those conduits so the relay system could be updated. However it still had not been done. Kara glared once more and then reached for her tool belt at the desk in front of her. Attaching the belt around her waist Kara removed her black jacket and stood in her yellow shirt it was easier to move about after all. “Right get ready to shut it down in 2 minutes!” Kara yelled, if they did not shut down the plasma flow it would cause a plasma fire when she opened the relay. As a voice replied that the flow was disabled Kara locked her fingers around the large door and began to pull. As the door had not been opened in some time and as it opened Kara wedged her fingers inside. With in a few seconds the doors were sealing again, Kara yanked her fingers back and then pulled out a spanner and proceeded to hit the door repeatedly whilst shouting at it for being so damn stubborn. There was a table set up for the captain's panel, and two tables in front. One for Tagon and his counsel, Lt. Commander Wilson, and another table for himself and Lt. Tybrin. Pitt wasn't so sure about this Tybrin. He did not have his heart in the letter of the law. There was no place for sentiment here. It was about justice and right and wrong. Tagon had kiled that Crytonian. No matter what the reason, that was wrong. Tybrin did not seem to share that ideal, and Pitt had a problem with that. For a JAG officer, all that attered was the law. He made his way over to his table and sat. He had brought a sizable bag with him and began to take items out of it. First he took out a series of PADDs and organized them on the table. Then he took out two, rather sizable volumes. They we court precedences. Several pages had been marked. Most lawyers kept their volmes on PADDs. But Pitt felt that the letter of the law was written, and to have a permanent, unabridged, unchangeable copy of the law with him, gave him the sense of comfort in the laws that he was trying to uphold. Now that he was set up Pitt sat back in his chair and took a deep breath. he could feel the excitement of the impending trial growing in him. He made a conscious effort to stay focused and keep himself relaxed. The evidence in this case was pretty open and shut and the JAG was fairly certain that there was no way he could lose this one. John rubbed his hands on his trousers once more the nervousness was making him sweat more and more. "You'll be very pleased by the results. I would say over 95% of the crew and civilians will be staying with us. A few from engineering and science have requested to remain. This is as true today in the 25th century as it was back then. The causes of the murder of Lessimax are far more important than the actual murder. The cause is unmistakable and by the end of this trial you to will believe as I do after firm scientific evidence that the murder was not a murder since Ensign Tagon did not commit it out of choice. My counter part will attempt to make you believe that the murder had motive and it was a choice of Tagon’s to murder Lemssinx however this is not true and I will prove it,” John paused and looked at the faces of the people. “ I myself have considered it a honour and a privilege to serve with this officer and hope to continue to do so. As he stood he remembered the first thing that he could remember his father saying to him. John took a deep breath and thought before he spoke. “Cicero once said the causes of events are ever more interesting than the events themselves. This is as true today in the 25th century as it was back then. The causes of the murder of Lessimax are far more important than the actual murder. The cause is unmistakable and by the end of this trial you to will believe as I do after firm scientific evidence that the murder was not a murder since Ensign Tagon did not commit it out of choice. My counter part will attempt to make you believe that the murder had motive and it was a choice of Tagon’s to murder Lemssinx however this is not true and I will prove it,” John paused and looked at the faces of the people. “ I myself have considered it a honour and a privilege to serve with this officer and hope to continue to do so. I know that by the end of this trial Ensign Tagon will be able to return to duty and he will be able to continue to be our friend and more importantly our protector,” John stated turning back from the podium and returning to his seat. Dru Tagon didn't even look. He really didn't care to see who had come to see him now. All he heard was the force field go down, but he never heard it go back up. Now this did make him curious to open one eye. There was a team of security officers standing with weapons drawn. Drulooked at them and frowned. A couple of them looked nervous. He didn't recognize them. A couple looked embarrassed. Those ones he knew. They were from the starbase. "Let's go Tagon," one of the JAG security men said. But the Brikar didn't move. "I said let's go." The JAG security officer repeated, sounding a little more irritated. Tagon pulled himself to his full heighth. he looked down at the man through narrowed eyes. "Until I have been court martialed and removed from my rank you will address me accordingly." The tone of his voice, matched with his hulking presence made the JAG officer wince. The Geneva men tryed hard to hold back smiles, unsuccessfully. "Fine," the JAG officer said, "Ensign Tagon. Your trial is about to begin." Then he turned to the Geneva men. "Bind him." The two men did not move. The others gave a noticable sigh of disdain and grabbed the restraints. They bound his hands in them. Tagon looked at the men, then at the resttraints. Then he fixed his eyes on the JAG security chief. Tagon lifted his arms up and with very little effort the manacles litterally fell apart, and clanged to the floor. "I will not be trussed up and marched through my own station," Tagon warned. The JAG security man could not hold his gaze for long. He did not have the fire that Dru did. Then Tagon straightened himself up and said, "Lead on, I am read for what awaits me." He followed the entourage of security to his trial. It is pretty rare that the Brikar felt self-coscious, but he did take a quick look to see if anything was amiss on his uniform. Then he made eye contact with Lt. He couldn't help but wonder if the chair supplied by the Commodore was made to order, to make the Brikar fell intimidated. It did not seem to be working since he simply stood, nonplussed by the whole thing. Finally a seat that was more appropriate had been secured and brought to the room and Tagon was able to sit. Pitt was sure he could feel the deck plating moan a little as the large being settled his weight into the modified seat. Commodore Blackwell stood before the assembly and read the charges from his PADD. "Ensign Dru Tagon, you are charged with Murder of one Colonel Lessimax and Conduct unbecoming a officer of the federation," Blackford took a deep breath obviously he was allowing the charges to sink in and for every one to realise them. "Attending the trial are Captains of Geneva, Cochrane and Steel Talons. Will the prosecution please make their opening statement and all please be seated," Pitt stood. It was time to start the show. This case pretty much sold itself to the law, so he really did not believe there would be much to it. "Captains, I would like to present to you the simple evidence of this case. First- Colnel Lemssinx is indeed dead. Second- He died at the hands of Ensign Dru Tagon, the defendant. Third- at the moment of his death, he was already in custody, and not resisting. In short, Ensign Tagon executed his prisoner and in so doing acted as judge, jury and exxecutor. Now this is still the Federation, and as I recall there is law and order in the Federation. No man should be allowed to take the law into his own hands when there is due process available to them. Unfortunately, for Colnel Lemssinx, Ensign Tagon does not hold to these standards. Indeed, he feels that he has done nothing wrong. Now the defense will try to tell you that Colnel Lemssinx was a bad man. I would not dispute that. In fact, I think the late Colnel was a cold hearted son of a bitch. But does that mean that we can go out and kill every cold hearted sons of bitches. We'd be very busy people. The defense will try to convince you that the good Ensign was not in control of his faculties at the time. If that is so, then do we want such a person roaming our starbases unattended, let alone being in charge of their security. At best, he should be under some form of psychiatric treatment, at worst, hospitalized until deemed safe to be in the general popultion. I can understand the sentiments that the crew of Starbase Geneva has. I actually have a great deal of respect for the Ensign, aswell as the long standing tradition of honor of the Brikarian race. However, even with that respect I cannot get past the evidence that Colnel Lemssinx is dead, Ensign Tagon killed him, and that at the time of his death he was already in custody. (reply any) (posted by Al Muir) Stardate:2406.07.01 Mission: Opportunities of Engagements/For our sins, day 5 Stardate: 2406.07.01 (Starbase Geneva - Conference Room - Ensign Ryan Johnson- 2202)   Ryan sat in the conference room watching the trial start.  Ryan had a small PADD in his right hand looking at it every once in awhile.  There was something not right about this whole situation, but Ryan could not put his finger on it.  Tagon was sitting in a chair that did not at all look big enough for him.  Ryan kept looking at his PADD and at Tagon and shook his head a little.  What could there be that everyone had missed.  Ryan tapped his PADD a few times and a list appeared on the screen.  Ryan looked over the list.  Ryan marked off that Tagon was check out by the doctor.  Then Ryan checked off that nothing was found in or on Tagon.  Ryan kept looking at his list and Ryan marked off that Tagon was not really definding himself much.  It almost looked as if Tagon was almost letting himself be put away. Ryan looked up when Lt. Pitt said  "Third- at the moment of his death, he was already in custody, and not resisting."  That was something in it it's self.  Tagon never said that he put Colnel Lemssinx under arrest.  In fact it never showed up while they were in the Holo-deck re-enacting what had taken place. Ryan kept thinking that something was really wrong with this whole situation.  Ryan looked up at Tagon and saw him just sitting in the chair like a big kid.  Ryan looked down at his PADD and typed up Tagon's personal record again.  Ryan kep looking over it and then it hit him.  Ryan read the PADD to himself again to see if he understood it right.  ~After graduating from Premier Military Academy of Brikkar Dru become an operative in a special operations unit.  It was in this unit that he was introduced to Starfleet.  His team was asigned to rescue a team of Starfleet personnel who were being held captive on a nearby planet.~  Ryan read the rest of his file and then Ryan switched over his PADD to what he had recoreded while in the Holo-Deck. There is was.  It was what Tagon had said to Colnel Lemssinx.  "Remember my promise Lemssinx,  Now is the time to pay."  Ryan could not understand when Tagon had been close enough to Lemssinx and when he had made the promise.  Ryan started to type on his PADD and look at Tagon's file more in depth.  The screen came up with ACCESS DENIED.  Ryan knew that he should be able to get into almost anyones files and the fact now that he could not get into Tagon's  file from way in the past bothered him. He stood up and addressed the panel, "I would like to call to the stand Lt. John Tybrin." (reply Tybrin) Pitt waited for Tybrin to be sworn in before he began.  "For the record could you please state your name, rank and current dutystation." (reply Tybrin) "Thank you Lt.," Pitt continued.  "Lt., you actually witnessed the death of Colnel Lemssinx, is that correct." (reply Tybrin) "Tell me Lt., ws anyone else in the room?" (reply Tybrin) "So your testimony and the computer logs are the only records of the events?" (reply Tybrin) "Have you reviewed the computer logs?" (reply Tybrin) "And in your opinion, have the records been altered at all?" (reply Tybrin) "So, would you say the the evidence presented in the computer logs is irrefutable?" (reply Tybrin) "Computer, please replay scenario Tagon 1." The potable holo-emitters that had been installed transformed part of the room into the shuttlebay of the Mithrandir and there was Tagon and Lemssinx. "Play recording." The holographic projection ran through the events of Tagon grabbing hold of Lemssinx. [ The Brikar used all of his strength to grab hold of Lemssinx.  His hand claspped around his neck.  Lemssinx let out a gurgle. With a deep breath Tagon pulled himself to his feet. Lemssinx's legs began kicking and thrashing wildly, to no avail. Tagon looked into his face.  I fit were possible he would have snarled. "I wanted to keep you alive, to get the security codes for you lock out, but now it appears that's not neccesary."  There was a quivering in the Brikar’s deep voice.  "Remember my promise Lemssinx, now is the time to pay." And with very little effort Dru Tagon squeezed. There was a snap and Lemssinx stopped struggling. He dropped the body of Lemssinx on the floor and tapped his comm badge. "Tagon to bridge, shuttlebay 3 is now secure."] Pitt turned to Tybrin.  “Are these the events that occurred on the shuttlebay that prompted you to arrest Ensign Tagon on the charge of murder?” (reply Tybrin) “Thank you Lt,” hPitt said, cutting off anything else that the JAG officer might say.  “I have no further questions for this witness.”   Pitt sat down, quite satisfied by the reaction of the Captain’s panel.
